RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, VOLUNTARY PARTICIPATION AND INDEMNITY AGREEMENT

In consideration of being permitted to participate in the FAVOR Adventures in Recovery program (“AiR Program”), I, on behalf of myself, my personal representatives, heirs, and assigns (collectively, “Participant”), hereby agree as follows.

1. I agree that FAVOR, all related corporations, subsidiaries, affiliated businesses, insurers, officers, directors, agents, employees, representatives, heirs and assigns (collectively “Company”) shall not be liable for payment for any injury which arises out of my participation in the AiR Program.

2. I agree that any participation in the AiR Program is completely voluntary, and not required in any way by FAVOR.

3. I agree to indemnify, release, waive, discharge and covenant not to sue FAVOR, all related corporations, subsidiaries, affiliated businesses, insurers, officers, directors, agents, employees, representatives, heirs and assigns (collectively “Releasees”) for any and all loss, liability, damage or cost, and any claim or demands therefore on account of injury, death, or property damage arising out of or related to the AiR Program, whether caused by the negligence of the Releasees or otherwise.

4. I agree that I assume full responsibility for any risk of bodily injury, death or property damage arising out of or related to the AiR Program whether caused by the negligence of Releasees or otherwise.

5. I agree that this Release and Waiver of Liability, Assumption of Risk, Voluntary Participation and Indemnity Agreement (“Agreement”) extends to all acts of negligence by the Releasees, and is intended to be as broad and inclusive as is permitted by the laws of the State of South Carolina, and that if any portion of this Agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

6. I agree that this Agreement constitutes the complete, final and exclusive agreement between the parties with regard to this subject matter. It is entered into without reliance on any promise or representation, written or oral, other than those expressly contained herein, and it supersedes any other such promises, warranties or representations. This Agreement may not be modified or amended except in a writing signed by the parties.

I HAVE READ THIS AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I MAY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND I REPRESENT THAT I HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Consent Form

The purpose of the disclosure authorized in this consent is to receive recovery support. I understand that my alcohol and/or drug treatment records are protected under the Federal regulations governing Confidentiality of Alcohol and Drug Abuse Patient Records, 42 C.F.R. Part 2, and the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R. Pts. 160 &164 and cannot be disclosed without my written consent unless otherwise provided for in the regulations. I also understand that I may revoke this consent at any time. I understand and agree to the following: 1. I grant permission for a volunteer to call me at the above phone number, email, and/or address to support me in my recovery. 2. Each time the volunteer calls, he/she will be asking me how my recovery is progressing and if I am in need of additional support (i.e., meetings in area, recovery community centers, safe/sober housing, social events, other resources). 3. At the time of the call, if I am in need of a referral to a treatment program or detox unit, I will be assisted in finding a program, if I so desire. 4. If at any time I decide not to take part in this program, I will contact the center or tell the volunteer when he/she calls.
