WAIVER AND RELEASE FORM

This Waiver and Release (the “Release”) signed by ____________________________________ (“Participant”) releases and the Participant agrees not to sue Breaking Barriers – Hope is Alive, doing business as Hope United, Tyler’s Redemption Place, and The Salt Cave at the Cabin (collectively “Hope”) and each of their officers, directors, sponsors, employees, agents, affiliates, and Participants. The Release is given by Participant in return for being allowed to participate in Hope’s Participant activities and all related activities, including any activities incidental to such participation (“Activities”). This is a release from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Activities wherever, whenever, or however the same may occur. I understand and agree that Hope is not responsible for any injury or property damage arising out of the Activities, even if caused by their ordinary negligence or otherwise. I understand that participation in the Activities involves certain risks, including, but not limited to, serious injury and death. I am voluntarily participating in the Activities with knowledge of the danger involved, and I agree to accept all risks of participation. I also agree to indemnify and hold harmless Hope for all claims arising out of my participation in the Activities. I am in good health and currently have no known mental or physical condition that would impair my capability for full participation as intended or expected of me in the Activities.

I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state Ohio and in any other state in which the Activities take place, and I agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.

I have carefully read the foregoing Release, I understand that it is a contract which grants certain rights to and eliminates the liability of Hope, and I sign this release as my own free act.

Consent Form

The purpose of the disclosure authorized in this consent is to receive recovery support. I understand that my alcohol and/or drug treatment records are protected under the Federal regulations governing Confidentiality of Alcohol and Drug Abuse Patient Records, 42 C.F.R. Part 2, and the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R. Pts. 160 &164 and cannot be disclosed without my written consent unless otherwise provided for in the regulations. I also understand that I may revoke this consent at any time. I understand and agree to the following: 1. I grant permission for a volunteer to call me at the above phone number, email, and/or address to support me in my recovery. 2. Each time the volunteer calls, he/she will be asking me how my recovery is progressing and if I am in need of additional support (i.e., meetings in area, recovery community centers, safe/sober housing, social events, other resources). 3. At the time of the call, if I am in need of a referral to a treatment program or detox unit, I will be assisted in finding a program, if I so desire. 4. If at any time I decide not to take part in this program, I will contact the center or tell the volunteer when he/she calls.
